The High Court in Accra has declined to proceed with the trial of former Cyber Security Authority Director-General Kwabena Adu-Boahene and his wife, Angela Adjei-Boateng, while the Supreme Court considers an application seeking to halt the proceedings during the legal vacation.
The court consequently adjourned the case to August 25, 2026, at 9:30 a.m., effectively putting the trial on hold pending the outcome of the Supreme Court application.
The decision followed a legal contest between lawyers for the accused persons and the prosecution over whether the High Court could continue hearing the case while an application seeking to restrain it remained pending before the apex court.
Peter Osei-Asamoah, who held brief for the accused persons, urged the High Court to suspend proceedings until the Supreme Court determines the injunction application, which has a return date of August 20.
Deputy Attorney General Dr Justice Srem-Sai opposed the request, arguing that merely filing an application for an injunction does not automatically prevent a lower court from proceeding with a case.
According to the prosecution, the High Court could only be prevented from continuing the trial if the Supreme Court had actually issued an injunction restraining it.
The trial judge, Justice Francis Achibonga, however, disagreed with that position.
Justice Achibonga held that where an application before the Supreme Court specifically seeks to restrain a lower court from taking a particular action, the lower court should refrain from proceeding with the very action being challenged until the application has been determined.

On that basis, the judge declined to continue the trial while the injunction application remained unresolved before the Supreme Court.
The Supreme Court is expected to consider the application on August 20, five days before the case returns to the High Court.
The outcome of the application will therefore determine whether the High Court can resume proceedings when the trial reconvenes on August 25.
